Özet
Temel hak ve özgürlükler arasında ifade özgürlüğünün öncelikli bir yeri
vardır çünkü bu özgürlük olmadan diğerlerini kullanmak olanaksız hale
gelmektedir. Düşünce ve ifade özgürlüğü toplumda daha iyi ve yeni fikirlerin
ortaya çıkmasına ortam hazırlayarak bunlar arasında bir seçim yapma imkanı
sağlar. Temel bir hak olan ifade hürriyeti, tarihi süreç içerisinde demokratik
toplumların anayasalarında ve insan haklarına ilişkin evrensel belgelerde yer almıştır.
Türkiye Cumhuriyeti Anayasası’nda hukuk devleti ilkesi temel ilkeler arasında
yer almış ve hukuk devletinin ilkelerine de yer verilmiştir. Fakat, Türkiye’de
ifade özgürlüğü ve genel olarak diğer temel insan hakları ve özgürlüklerinin
korunması ve geliştirilmesi için öncelikle iç hukukta bazı düzenleme ve
yenileştirmelerin yapılması gereklidir.

Abstract
The freedom of speech is very prominent among the fundamental rights and freedoms because of its being compulsory component in order to use the others. The freedom of thought and speech provides the base for the new ideas and novelties and opportunity to choose the best one for any society. The freedom of thought and speech as the fundamental right has been placed within the constitutions of the democratic societies during the historical process and the universal documents pertaining with the human rights. The principal of supremacy of law has been considered as the fundamental right in the Constitution of Turkish Republic. Nevertheless, the new reforms and regulations in internal law are necessarily required in order to preserve and develop the fundamental human rights and freedoms.
